ART. 129
Local council's responsibilities
(1) The local council has initiative and decides, within the limits of the law, on all matters of local interest, except those that are within the competence of other local or central authorities.
(2) The local council exercises the following categories of responsibilities:
a) responsibilities regarding the administrative-territorial unit, its own organization, as well as the organization and functioning of the mayor's specialized apparatus, local public institutions, and local autonomous companies and boards;
b) responsibilities regarding the economic, social, and environmental development of the commune, town, or municipality;
c) responsibilities regarding the administration of the public and private domain of the commune, town, or municipality;
d) responsibilities regarding the management of local public services;
e) responsibilities regarding interinstitutional cooperation at national and international levels.
(3) In exercising the responsibilities provided for in paragraph (2) letter a), the local council:
a) approves the statute of the commune, town, or municipality, as well as the regulations on the organization and functioning of the local council; an indicative model of the territorial administrative unit's statute and an indicative model of the local council's regulations are approved by the minister in charge through an order;
b) elects the deputy mayor(s) from among the local councilors, at the proposal of the mayor or the local councilors, in accordance with Article 152 paragraph (2);
c) approves, in accordance with the law, at the proposal of the mayor, the establishment, organization, and staffing of the mayor's specialized apparatus, local public institutions, the reorganization and staffing of local autonomous companies, as well as the establishment, reorganization, or dissolution of local companies and their staffing;
d) exercises, on behalf of the administrative-territorial unit, all the rights and obligations corresponding to the participations held in companies or autonomous boards, in accordance with the law;
e) decides on the establishment or reorganization of institutions, public services, companies, and autonomous boards, in accordance with the law.
(4) In exercising the responsibilities provided for in paragraph (2) letter b), the local council:
a) approves, at the proposal of the mayor, the budget of the administrative-territorial unit, credit transfers, the use of the budget reserve, and the closing account of the budgetary exercise;
b) approves, at the proposal of the mayor, the contracting and/or guaranteeing of loans, as well as the contracting of local public debt through the issuance of securities, on behalf of the administrative-territorial unit, in accordance with the law;
c) establishes and approves local taxes and fees, in accordance with the law;
d) approves, at the proposal of the mayor, the technical and economic documentation for local investment works, in accordance with the law;
e) approves strategies for the economic, social, and environmental development of the administrative-territorial unit;
f) ensures a favorable environment for the establishment and/or development of businesses, including through the valorization of existing assets, as well as through the realization of new investments that contribute to the fulfillment of regional and local economic development programs;
g) ensures the completion of works and takes the necessary measures for the implementation and compliance with the provisions of the commitments undertaken by Romania as a member state of the European Union in the field of environmental protection and water management for the services provided to citizens.
(5) If the budget of the administrative-territorial unit, provided for in paragraph (4) letter a), cannot be adopted after two consecutive meetings, which take place within a maximum of 7 days, the activity is carried out based on the previous year's budget until the new budget is adopted, but no later than 45 days from the date of publication of the state budget law in the Official Gazette of Romania, Part I.
(6) In exercising the responsibilities provided for in paragraph (2) letter c), the local council:
a) decides on the administration, concession, lease, or free use of public property belonging to the commune, town, or municipality, as applicable, as well as of local public services, in accordance with the law;
b) decides on the sale, administration, concession, free use, or lease of private property belonging to the commune, town, or municipality, as applicable, in accordance with the law;
c) approves or authorizes, in accordance with the law, territorial planning and urbanism documentation for localities;
d) assigns or changes, in accordance with the law, the names of streets, squares, and any other objects of local public interest.
(7) In exercising the responsibilities provided for in paragraph (2) letter d), the local council ensures, within its competence and in accordance with the law, the necessary framework for the provision of local public services regarding:
a) education;
b) social services for the protection of children, persons with disabilities, elderly persons, families, and other individuals or groups in need;
c) health;
d) culture;
e) youth;
f) sports;
g) public order;
h) emergency situations;
i) environmental protection and restoration;
j) the preservation, restoration, and enhancement of historical and architectural monuments, parks, public gardens, and nature reserves;
k) urban development;
l) population records;
m) bridges and public roads;
n) community public utility services of local interest;
o) emergency services such as mountain rescue, lifeguard, and first aid;
p) social and community administration activities;
q) social housing and other housing units owned by or under the administration of the administrative-territorial unit;
r) the valorization, in the interest of the local community, of natural resources within the administrative-territorial unit;
s) other local public services established by law.
(8) In exercising the responsibilities provided for in paragraph (2) letter d), the local council:
a) supports, in accordance with the law, the activities of religious denominations;
b) approves the construction of social housing, the criteria for the allocation of social housing, and the allocation of housing utilities owned or administered by the administrative-territorial unit.
(9) In exercising the responsibilities provided for in paragraph (2) letter e), the local council:
a) decides, in accordance with the law, on cooperation or association with Romanian or foreign legal entities, for the financing and joint implementation of actions, works, services, or local public interest projects;
b) decides, in accordance with the law, on twinning the commune, town, or municipality with administrative-territorial units from other countries;
c) decides, in accordance with the law, on cooperation or association with other administrative-territorial units in the country or abroad, as well as on joining national and international associations of local public administration authorities, for the promotion of common interests.
(10) In exercising the responsibilities provided for in paragraph (2) letter a), b), and d), the local council:
a) may provide, in whole or in part, with the agreement of the owner or administrator, the works and funds necessary for the rehabilitation, equipping, and functioning of buildings where authorities or public institutions carry out activities of local interest. The goods purchased for equipment remain the property of the administrative-territorial unit;
b) may provide, in whole or in part, with the agreement of the institution or public authority holding the right of ownership or administration, works for the arrangement, equipping, and maintenance of buildings or land owned by the state, in order to increase the level of tourist attractiveness of the administrative-territorial unit, provided that, through the expressed agreement, the holder of the right allows public access to the improved spaces for a minimum period of 5 years. The goods purchased for equipment remain the property of the administrative-territorial unit.
(11) In order to fulfill the responsibilities provided for in paragraph (2), the local council may request information and reports from the mayor, deputy mayor, and the heads of public service providers and local public utility providers.
(12) Consiliul local hotărăşte acordarea unor sporuri şi a altor facilităţi, potrivit legii,
personalului angajat în cadrul aparatului de specialitate al primarului şi serviciilor publice
de interes local.
(13) Consiliul local poate conferi persoanelor fizice române sau străine cu merite
deosebite titlul de cetăţean de onoare al comunei, oraşului sau municipiului, în baza unui
regulament propriu. Prin acest regulament se stabilesc şi condiţiile retragerii titlului
conferit. Acest regulament poate fi parte integrantă a statutului unităţii administrativteritoriale.
(14) Consiliul local îndeplineşte orice alte atribuţii, în toate domeniile de interes local, cu
excepţia celor date în mod expres în competenţa altor autorităţi publice, precum şi orice
alte atribuţii stabilite prin lege.
